TEXAS STATE LAWS REGARDING DELTA 8 THC AND CBD

Over two-thirds of states have legalized the use of medical marijuana, while about a third have legalized recreational use. Unfortunately, in Texas there is a bit of confusion surrounding the legality of Delta 8.

On October 15, 2021, Texas announced that Delta 8 was illegal, and considered a Schedule 1 substance.  This was a huge blow to CBD stores across the state of Texas, and left consumers faced with the possibility of a felony for possessing Delta 8 products.

However, State District Court Judge Jan Soifer granted a temporary injunction against the state in order to ensure that selling and obtaining Delta 8 would not result in a felony offense.  This injunction, for now, has made Delta 8 products legal again in the State of Texas.

Hemp cannabis was legalized at the federal level with the passage of the 2018 Farm Bill, allowing for the cultivation, production, distribution, transportation, sale, and possession of hemp and hemp products containing 0.3% or less THC.

What is the Legal Status of CBD in Texas?

The state allows only CBD products containing 0% Delta 9 THC for average citizens. It can be sold as oils, powders, pills, and topical lotions.

In 2019, Texas House Bill 1325 passed during the 86th Regular Session and was signed by the governor on June 10th, 2019. This bill amended the Texas Agricultural Code and the Health & Safety Code in order to regulate the growth of industrial hemp and the sale of consumable hemp products like CBD oil.

What About CBG?

When CBG is derived from hemp cannabis, it is considered legal in all 50 states. With that being said, it’s important to remember that Texas has stricter laws regarding THC, so any cannabis products sold in the state must be free of Delta 9 THC.

Is Delta 8 THC Legal in the State?

Technically, yes. Only Delta 9 THC is expressly prohibited in the state of Texas.
