MARYLAND STATE LAWS REGARDING DELTA 8 THC AND CBD

Over two-thirds of states have legalized the use of medical marijuana, while about a third have legalized recreational use. Although weed is not legal in Maryland for recreational use, the State of Maryland has legalized medical marijuana use.

Maryland’s HB 881 was signed by Gov. Martin O’Malley in 2014. HB 881 created the Natalie M. LaPrade Maryland Medical Cannabis Commission (MMCC) and gave it the responsibility for establishing regulations for the legal consumption, cultivation, possession, and distribution of cannabis products to patients 18 and older.

MMCC released its regulatory changes in August 2019. They added dentists, certified nurse midwives, nurse practitioners, and podiatrists to the list of providers for medical marijuana in Maryland.

The MMCC oversees all licensing, registration, inspection, and testing pertaining to Maryland’s medical marijuana program. It also oversees the registry for patients and caregivers, in order for State of Maryland make sure that medical marijuana is made available in a safe and effective manner.

 

Hemp cannabis was legalized at the federal level with the passage of the 2018 Farm Bill, allowing for the cultivation, production, distribution, transportation, sale, and possession of hemp and hemp products containing 0.3% or less THC.

What is the Legal Status of CBD in Maryland?

Is Delta 8 THC Legal in the State of Maryland?

Yes, Delta 8 THC is legal in Maryland.

It was House Bill 1123 which helped to remove hemp derived products from the Controlled Substances Act, and it also defined the type of tetrahydrocannabinol (THC) Maryland would regulate moving forward.

The Act eliminates hemp derived cannabinoids under the following:

“Marijuana” does not include… [the plant Cannabis sativa L. and any part of such plant, whether growing or not, with a delta–9–tetrahydrocannabinol concentration that does not exceed 0.3% on a dry weight basis] HEMP AS DEFINED IN § 14–101 OF THE AGRICULTURE ARTICLE.

In 14-101 of the Agriculture Article, it goes on to further define the following:

[“Industrial hemp”] “HEMP” means the plant Cannabis sativa L. and
any part of [such] THAT plant, INCLUDING ALL DERIVATIVES, EXTRACTS,
CANNABINOIDS, ISOMERS, ACIDS, SALTS, AND SALTS OF ISOMERS, whether growing or not, with a delta–9–tetrahydrocannabinol concentration that does not exceed 0.3% on a dry weight basis.

The above legislation passed into law by Maryland falls right in line with the federal Hemp Farm Bill, and therefore makes hemp products with less than 0.3% Delta 9 THC is legal. So as long as it is derived from hemp, and Delta 9 THC levels remain below 0.3%, Delta 8 THC is legal in Maryland.
