MAINE STATE LAWS REGARDING DELTA 8 THC AND CBD

Over two-thirds of states have legalized the use of medical marijuana, while about a third have legalized recreational use. Maine was one of the first few states in the United States to legalize recreational use of marijuana, and was at the forefront of the legal cannabis movement.

Since then, the Maine legislature has made changes, and compromises in order to pass an amended law, LD 1719. Among the changes was reducing the number of marijuana plants a person is allowed to grow at home from six to three. The Legislature also made private property as the only place where recreational cannabis can be consumed. There is a $100 fine for consuming cannabis in public.

What does this mean for residents of Maine, and how does the Pine Tree State treat compounds like cannabidiol (CBD), cannabigerol (CBG), and delta-8-tetrahydrocannabinol?

What is the Legal Status of CBD in Maine?

You might think the answer to this question is pretty straightforward since the 2018 Farm Bill legalized hemp cannabis in the U.S., including all 50 states. However, there are still some states, such as Kansas, that maintains stricter laws where CBD is concerned.

The state of Maine however has been at the forefront of the cannabis movement in the United States, which originally dates all the way back to 1999 for medicinal use.  And now Maine is a fully recreational use state.

  • If a food product containing CBD is sold in a restaurant, the menu must clearly state the inclusion of CBD and the weight by item.

What About CBG?

When CBG is derived from hemp cannabis, it is considered legal in all 50 states. With that being said, all the above laws that are stated about CBG, are also relevant to all CBG products in the state of Maine.

Is Delta 8 THC Legal in the state of Maine?

Yes, Delta 8 THC is legal in Maine.

Maine has amended their hemp legislation to include all derivatives of hemp including “topical or ingestible consumer products, including food, food additives and food products derived from hemp” that contain less than 0.3% Delta 9 THC.

With the passage of §2231. Hemp of Title 7: AGRICULTURE AND ANIMALS states the following:

“Hemp” means the plant Cannabis sativa L. and any part of that plant, including the seeds and all derivatives, extracts, cannabinoids, isomers, acids, salts and salts of isomers, whether growing or not, with a delta‑9‑tetrahydrocannabinol concentration of not more than 0.3% on a dry weight basis, or as otherwise defined in federal law. “Hemp” includes agricultural commodities and products derived from hemp and topical or ingestible consumer products, including food, food additives and food products derived from hemp, which in their final forms contain a delta-9-tetrahydrocannabinol concentration of not more than 0.3% or as otherwise defined in federal law. “Hemp” does not include marijuana for medical use pursuant to Title 22, chapter 558‑C or adult use marijuana pursuant to Title 28‑B, chapter 1.

According this law, all hemp derivatives, including Delta 8 THC, are legal in the state of Maine, as long as the Delta 9 THC levels are less than  0.3%,  as measured on a dry weight basis.
