Over two-thirds of states have legalized the use of medical marijuana, while about a third have legalized recreational use. Maine was one of the first few states in the United States to legalize recreational use of marijuana, and was at the forefront of the legal cannabis movement.

As a matter of fact, Maine actually legalized medical marijuana use in 1999, for patients suffering from serious health conditions.

On Nov. 8, 2016, Maine voters passed An Act to Legalize Marijuana, which allows adults over the age of 21 to possess, consume, and cultivate marijuana for personal use. Since then, the Maine legislature has made changes, and compromises in order to pass an amended law, LD 1719. Among the changes was reducing the number of marijuana plants a person is allowed to grow at home from six to three. The Legislature also made private property as the only place where recreational cannabis can be consumed. There is a $100 fine for consuming cannabis in public.

What does this mean for residents of Maine, and how does the Pine Tree State treat compounds like cannabidiol (CBD), cannabigerol (CBG), and delta-8-tetrahydrocannabinol?

What is the Legal Status of CBD in Maine?

You might think the answer to this question is pretty straightforward since the 2018 Farm Bill legalized hemp cannabis in the U.S., including all 50 states. However, there are still some states, such as Kansas, that maintains stricter laws where CBD is concerned.

The state of Maine however has been at the forefront of the cannabis movement in the United States, which originally dates all the way back to 1999 for medicinal use.  And now Maine is a fully recreational use state.

With that being said, Maine is also one of the very few states that allows the sale and possession of CBD products, whether they are derived from hemp or marijuana.

CBD products sold in Maine must meet the following labeling requirements:

  • All labels must include the ingredients, the amount by weight, and the name, address, and zip code of the manufacturer.
  • Labels must not include any health claims, including that hemp, CBD, or the product can diagnose, treat, cure, or prevent any disease, injury, or condition.
  • If a food product containing CBD is sold in a restaurant, the menu must clearly state the inclusion of CBD and the weight by item.

What About CBG?

When CBG is derived from hemp cannabis, it is considered legal in all 50 states. With that being said, all the above laws that are stated about CBG, are also relevant to all CBG products in the state of Maine.

Is Delta 8 THC Legal in the state of Maine?

Yes, Delta 8 THC is legal in Maine.

Maine has amended their hemp legislation to include all derivatives of hemp including “topical or ingestible consumer products, including food, food additives and food products derived from hemp” that contain less than 0.3% Delta 9 THC.

With the passage of §2231. Hemp of Title 7: AGRICULTURE AND ANIMALS states the following:

“Hemp” means the plant Cannabis sativa L. and any part of that plant, including the seeds and all derivatives, extracts, cannabinoids, isomers, acids, salts and salts of isomers, whether growing or not, with a delta‑9‑tetrahydrocannabinol concentration of not more than 0.3% on a dry weight basis, or as otherwise defined in federal law. “Hemp” includes agricultural commodities and products derived from hemp and topical or ingestible consumer products, including food, food additives and food products derived from hemp, which in their final forms contain a delta-9-tetrahydrocannabinol concentration of not more than 0.3% or as otherwise defined in federal law. “Hemp” does not include marijuana for medical use pursuant to Title 22, chapter 558‑C or adult use marijuana pursuant to Title 28‑B, chapter 1.

According this law, all hemp derivatives, including Delta 8 THC, are legal in the state of Maine, as long as the Delta 9 THC levels are less than  0.3%,  as measured on a dry weight basis.

Broad Spectrum vs. Full Spectrum

Full-spectrum CBD contains all of the chemical compounds naturally occurring in the plant, which amounts to roughly 400 substances. Cannabis consists of terpenes, flavonoids, and over 100 cannabinoids that interact with the endocannabinoid system, including Delta 9 THC, the cannabinoid responsible for psychoactive effects.

Hemp cannabis, which is legal federally, features 0.3% or less THC, so it should be legal in every state. And although there are still states left that don’t coincide with the federal bill, Maine in fact does.  So as long as the CBD products contain less than 0.3% Delta 9 THC, then Full Spectrum CBD oil, and Broad Spectrum CBD oil are both legal.

What is the Difference Between Delta-8 THC and Marijuana?

Some of the biggest confusion over cannabis products comes from Delta 8 THC and Marijuana (Delta 9 THC) Gummies. While they’re more similar than different, there are important distinctions you should consider before buying.

Both Delta 8 and Delta 9 THC occur naturally within cannabis plants. Both create psychotropic effects in users called a “high.” And both are chemically very similar. In chemical terms, Delta 8 is an isomer of Delta 9, meaning it possesses the same elements but a different chemical structure.

That difference is important. The change in chemical structure causes the molecules to interact slightly differently in the body. Where Delta 9 slots perfectly into receptors in the endocannabinoid system, Delta 8 doesn’t fit as easily.

The chemical difference means that Delta 8 produces a less potent high. Delta 9 THC creates an intense and heady experience. It can make users feel euphoric, get the giggles, feel hungry, and become tired. Delta 8 creates effects that similar, but less potent.

The high Delta 8 produces is gentler and more clear-headed. It’s also less likely to lead to feelings of paranoia.
