Is Delta 8 Legal in Alabama?

Yes, Delta 8 THC is legal in Alabama. On 4/29/2021, a new bill sponsored by Representatives Holmes and Allen passed both chambers and was delivered to the governor to sign into law.  In this bill, it broadens the state of Alabama’s view on THC.  Instead of specifically looking at the Delta 9 THC levels, it generalizes (all) Tetrahydrocannabinols “except for tetrahydrocannabinols in hemp”.

With this piece of legislation, Alabama is specifying “all parts and varieties of the plant” which includes isomers of hemp, such as Delta 8 THC, salts of isomers, and more as legal under state law– as long as the Delta 9 THC levels do not exceed 0.3%, such as written in the federal Hemp Farm Bill of 2018.

ALABAMA STATE LAWS REGARDING DELTA 8 THC AND CBD

Over two-thirds of states have legalized the use of medical marijuana, while about a third have legalized recreational use.  At this time, marijuana is legal for medical use and with a prescription.

Hemp cannabis was legalized at the federal level with the passage of the 2018 Farm Bill, allowing for the cultivation, production, distribution, transportation, sale, and possession of hemp and hemp products containing 0.3% or less THC.
